At the EL SFT Roundtable event in October, Charles Cory-Wright QC and Emily Formby of 39 Essex Chambers joined EL SFT members and guests to speak on the development of the principle of “fundamentally dishonest”, a concept highlighted in the case of Summers v Fairclough Homes in 2012; subsequently expanded by Section 57 of the Criminal Justice and Courts Act 2015; and embedded into the CPR through the introduction of the rules on QOCS.
