Anyone with even a marginal interest in evolving conveyancing case law would be hard pressed to have avoided the recent changes in the battlefield in respect of rights to light inquiries, and the varying application of the “Shelfer” test with regards to the contentious issue of damages vs. injunction (and the level of such damages) where a right to light is challenged.
