This month, Eversheds looks at several liability cases involving contributory negligence and the Fairchild “material” contribution test, as well as costs and procedure cases regarding recovering NHS compensation charges and fraud case management.
The Claimant was a 14 year old girl who was riding a horse with a friend. Her friend crossed the road on her horse and the Claimant then started to follow but was struck by the Defendant’s motor home which caused the horse to fall on her, injuring her.
